Judge who sentenced Sarí Côrte Real asks for investigation against Miguel’s family for mistreatment and humiliation of the child

The request was made, based on testimonies of the process, in the sentence that sentenced Sarí Côrte Real.

Judge José Renato Bizerra, head of the 1st Court of Crimes against Children and Adolescents in the Capital, requested that Mirtes Renata Santana and Marta Santana, mother and grandmother of Miguel Otávio, be investigated for evidence of mistreatment, humiliation, racism and detention against the child. The request was made, based on testimonies of the process, in the sentence that sentenced Sarí Côrte Real.

Miguel died when he leaned over the area where the air conditioners are located in the building where Sarí lives, in the neighborhood of São José, and fell. He was looking for his mother, Mirtes, who had left the house to walk Sarí’s dog. Death was in June 2020.

O investigation request against Mirtes Renata Santana, Miguel’s mother, and Marta Maria Santana, the boy’s grandmother, was made in the sentence handed down by the judge. The magistrate claims, based on testimonies of witnesses for Sarí’s defense, that Miguel was tortured, suffered abuse and racial prejudice

Based on article 13, §2, “b”, of the Penal Code, which deals with the causal relationship resulting from the action or omission of the defendant, Judge José Renato Bizerra, from the 1st Court of Crimes Against Children and Adolescents of the Recife, sentenced Sari Corte Real to eight years and six months in prison for abandoning an incapable person, resulting in death.

In June, Sari’s defense, led by the law firm Célio Avelino de Andradeasked Professor Cláudio Brandão for an opinion on the penal framework of Miguel Silva’s death, who maintained that Sarí is not automatically responsible for the death for having let the child enter the elevator alone.
