The ‘Nevermind’ baby sues Nirvana again for child pornography

Just when we thought the drama would come in Spencer Elden (the baby on the cover of the ‘Nevermind’) Y Nirvana had finished; international media they report that From hand You are not willing to give up so easily on your requests. After a judge threw out his initial lawsuit last week, the 30-year-old has again filed another, thus complying with the requirements stipulated by the court to be able to continue with the legal process.

From hand, who was photographed as a baby on the cover of the ‘Nevermind’ 1991, filed a first lawsuit in August 2021 against the gang’s surviving members, the widow of Kurt Cobain, Courtney Love, and the partners of Nirvana. He alleged that the image of his four-month-old underwater self with exposed genitalia was child pornography, and said that by being distributed worldwide Nirvana had participated in a “Sex trafficking company.”

The surviving members of Nirvana, Dave Grohl Y Krist Novoselic, as well as Love; filed a motion to dismiss the lawsuit for From hand December 22. Spencer and his attorneys did not respond to the motion of Nirvana before the December 30 deadline, prompting the judge in the case to rule in favor of the band. However, he had the option of resubmitting an amended claim before January 13, which he apparently already did (via Rolling Stone).

In the amended complaint, filed last Wednesday (January 12), From hand states that Nirvana:

He intentionally commercialized child pornography featuring Spencer and took advantage of the lewd nature of his image to promote the Nevermind album, the band and Nirvana’s music, while making at least tens of millions of dollars in total. ”

However, the new paper omits the claim for sex trafficking. In addition to requesting monetary compensation, From hand has requested that the cover art be changed for all future reissues of the ‘Nevermind’.

In the motion in response to the initial demand of From hand, the lawyers of Nirvana they argued that:

Spencer Elden he has spent three decades benefiting from his celebrity as the self-styled ‘Baby of Nirvana.’

“He has returned to represent photography in exchange for remuneration, many times; he has the album name ‘Nevermind’ tattooed on his chest; appeared on a talk show wearing a nude self-parody bodysuit; has autographed copies of the album cover for sale on eBay; and he has used the connection to try to attract women…. There is no doubt that the demands of From hand they will fail fundamentally ”.
