They reject prison for accused of homicide in Cartagena: he had tried to leave the country

A man accused of the murder of a merchant at the Yungay free fair in Cartagena will remain detained, after the San Antonio Guarantee Court rejected the preventive detention measure. The defendant was captured while trying to leave the country.

The San Antonio Guarantee Court rejected the request of the Public Ministry to order the precautionary measure of preventive detention against a man charged with the murder of a 40-year-old merchantin the commune of Cartagena, Valparaíso region.

The incident occurred in early June in the middle of a free fair, when residents of the Yungay sector reported a shootout.

While trying to leave the country for Argentina, the Investigative Police arrested a man with the initials CATR, accused of the murder of the 40-year-old merchant in the Cartagena district.

The San Antonio prosecutor, Juan Carlos Catalán, stated that the victim threatened those who were in the place, being attacked by three individuals. Catalan added that those responsible fired between four and five times.

The alleged perpetrators fled aboard a gray truck, which was captured by security cameras in the sector.

Of the other two, one is also a defendant in this case, who pointed out as responsible the CATR initials man.

Such accusation was questioned by the defense attorney, Manuel Jesús López, who also pointed out that his client I wasn’t trying to flee the country when he was arrested.

“He did not have any current arrest warrant against him (…) the only evidence that the Public Ministry has to charge my representative is the statement of one who is a person accused of being guilty by another,” López said.

The Guarantee Court of San Antonio rejected the request of the Public Ministry, in order to order the injunction of preventive prison against the accused.

Thus, the Prosecutor’s Office announced that it will appeal to the Court of Valparaíso, while the accused will remain in custody and await the resolution of the judicial appeal.
