Council of State approves five new decree-laws

The Council of State of Cuba approved this Wednesday five new decree-laws and analyzed the draft laws of Courts of Justice, the Administrative Process, the Criminal Process and the Code of Processes, for presentation to the deputies in the next Ordinary Period of Sessions of the Cuban Parliament, according to reported the Cuban News Agency.

Two of the decree laws (“Del Banco Popular de Ahorro” and “Del Banco Exterior de Cuba”) seek to strengthen the banking and financial system of the country and adapt their content to the provisions of Decree-Law 362 (“Of the Institutions of the System Banking and Finance “), of September 14, 2018, which determines the legal regime for the constitution, organization, operation, regulation, supervision, surveillance and sanction of the institutions and entities that operate in this area.

Another of those approved was the decree-law “On the System of Aids to Navigation of the Hydrographic and Geodetic Service of the Republic of Cuba” and regulates what is related to this issue in the aquatic spaces under the jurisdiction of the country, in accordance with current national legislation. and to international treaties and conventions to which the State is a party.

The decree-law “On the Maternity of the Worker and the Responsibility of the Families” were also issued, which aims to expand benefits for working women, and the decree-law “On the Labor Condition and the Special Social Security Regime of Creatives in the Sphere of Social Communication “, which recognizes the employment status of creative communicators and establishes the special social security regime.

Regarding the mechanism regarding maternity, Teresa Amarelle Boué, secretary general of the Federation of Cuban Women (FMC), declared that it constitutes a sample of the political will of the Cuban State to achieve – “the advancement of women.” According to the note from the official agency, “the norm increases the rights of working mothers in the state sector and grants equal rights to working mothers in the non-state sector: the right to enjoy social benefits, monetary benefits for medical certificates of pregnant women and mothers with sick children, and supplementary maternity leave “.

Marta Elena Feito Cabrera, Minister of Labor and Social Security, specified this new provision guarantees protection to the father or another working relative of those specified who takes care of the minor, in the event of the mother’s death, and grants the right to enjoy of social benefits to grandparents who are caring for a minor whose mother is a student to help the continuity of studies and autonomy of women.

Regarding the provision on communicators, Feito Cabrera reported that the employment status is granted to professionals affiliated with the Cuban Association of Social Communicators who generate products for political, advertising, public and institutional purposes, in order to promote the circulation of the best communication products in the country.

In addition, creative workers may carry out their work individually or in multidisciplinary teams, without prejudice to their relationship with any entity.

Until now, the decree-laws have not been published in the Official Gazette of the Republic of Cuba, and the note did not specify on what date they would appear.

Regarding the draft laws of the Courts of Justice, the Administrative Process, the Criminal Process and the Code of Procedures, presented by Rubén Remigio Ferro, president of the Supreme People’s Court, it was indicated that they will be presented in the Seventh Ordinary Period of Sessions of the National Assembly of People’s Power in its IX Legislature, convened for next October 27.

The meeting was chaired by the president of the National Assembly of People’s Power, Esteban Lazo Hernández, and was attended, via videoconference, by President Miguel Díaz-Canel Bermúdez and the Prime Minister, Manuel Marrero Cruz.
